Objet
This contract concerns:
1. "My Selection" on the products presented
on this Internet site,
2. the sale of these products, within the limit
of the available quantities, between "Les Passions
de Nanou" and a purchaser, and this within
the limits of a system of remote sale.
Applicable
law
This contract refers to the French right and the
regulation of the remote sale.
Wishes of
purchase
Internet site www.vini-passion.com makes it possible
to stop "My Selection" on the Bottles
of Exception and the Great Vintages presented on
this site.
The "Desired" products appear in the heading
"My Selection".
As of reception of this request, "Les Passions
de Nanou" turns over you:
whether "a Purchase order" if the desired
quantities are available,
or "a proposal of Purchase order" if the
desired quantities are not available.
Valid offer within the limit of available
stocks.
Purchase order
The order will be possible only after confirmation
with the customer of the Purchase order by "Les
Passions de Nanou".
For all the actual sales, it is the French taxes
(VAT) which applies, that is to say 19,6% of tariff
HT - postage and packing not included.
The indicated prices on the site are T.T.C in Euros
except forwardings expenses and within the limit
of available stocks. The prices can be modified
without notice.
Forwarding
costs and insurance
Our products travel in declared value (insurance,
theft and damage)
The Forwarding costs being able to be the subject
of an estimate according to the destination, the
insurance costs variable with the value of the products,
will be mentioned on the Purchase order and the
invoice.
Payment
Our products are sold including all taxes, VAT 19,6%
included. Payable on order.
The invoicing is only effected in Euro.
The payment is effected:
- by credit transfer (France, Europe,
International) made out with the order of
"Les Passions de Nanou".

Term of Delivery
The average time of delivery is 7 to 9 working days.
"Les Passions de Nanou" could not be held
responsible for the delays of delivery due to the
post office or the conveyor.
Guarantee and responsibility
The products forming the subject of a description,
when those can present defects (not harming of anything
their quality), no guarantee can be called. "Les
Passions de Nanou" cannot be held responsible
for the damage (run-outs for example) which have
occurred on old bottles, taking into account their
brittleness, during their transport. "Les Passions
de Nanou" does not guarantee the quality of
the wines especially the old vintages.
"Les Passions de Nanou" cannot be held
responsible for breach of its obligations (defined
under these general conditions of sale) in case
of absolute necessity.
Damage during transport:
You should accept a parcel only if external packing
does not show any trace of shock or deterioration
of the transported goods. You commit yourselves
making a complete control with the reception: inspect
in the presence of the factor or deliveryman the
good state of the contents of the parcel and to
issue reserves near him, in quality or quantity,
to be able to obtain a compensation in the event
of deterioration. It is not sufficient to write
on the advice of reception “subject to opening”,
these reserves not having any legal authenticity.
No compensation will be possible in this case. The
character of the reserve must be indicated clearly
like that of the refusal of the parcel if necessary.
Term of consideration and retractation
Term of 24 hours for retractation after the confirmation
of order by email by "Les Passions de Nanou".
During these 24 hours the customer can cancel his
order without being penalized by addressing an email
of retractation to nanou@vini-passion.com.
In accordance with l’article L121-16 of the
Code of Consumption, term of consideration 7 days
is envisaged as from the day of the reception of
the goods. The customer can turn over the products
by joining the delivery order to it, without to
have used them, in their packing of origin, in the
event of the received product does not correspond
to the bought product. First, come into contact
with "Les Passions de Nanou" for the instructions
of sending back. The expenses of return are the
responsibility of the customer. In the event of
exercise of the right of retractation, after reception
of the products in good condition, "Les Passions
de Nanou" is committed refunding you the entirety
of the sums paid within 30 maximum day.
Guarantees
and after-sales service
If the product that you received comprises vice
hidden, want to inform the "Les Passions de
Nanou" as soon as possible.

You must return the goods within a short time by
joining the delivery order to it.
If the product is not available, and in this case
only, "Les Passions de Nanou" is committed
refunding you the entirety of the versed sums and
this within 60 maximum days.
Confidentiality
As a commercial site, "Les Passions de Nanou"
collects necessary informations to the delivery.
These informations are obligatory. "Les Passions
de Nanou" treats all these data with the greatest
confidentiality. In accordance with the Data-processing
Law and Freedoms of January 6, 1978, you have a
right of access and of correction to the data concerning
you.

Reserve property
The products are only dispatched after their
payment in full.In any event, the goods remain the
property of "Les Passions de Nanou" until
the payment in full of the price.
Litigations
The parties agree on that the disagreements which
have suddenly occurred following the present contract
will be competence of the jurisdiction of the town
of Dax.
